Welcome to the Classic Digital Photography website, which you will use to make orders
and book appointments. The terms and conditions are written on the subject of any
submissions of content using the website, the production of any prints, the delivery of
any prints, whether through physical or online delivery, the privacy of your information,
and any service or product provided by Classic Digital Photography.
These terms and conditions can be held as applicable for both business conducted on
the website, as well as in person. Classic Digital Photography reserves the right to
change these terms and conditions without notifying users; thus, it is up to the user to
stay updated on any modifications.
By clicking “I Agree”, you will be agreeing to all the clauses stated in this contract.
This agreement will be made effective on the date you click “I Agree”, and such date will
be enforced and referred to if any issues are to arise.
The customer also accepts the responsibilities of any agreements made verbally
between the two parties.
Terms and Conditions
Services
The Classic Digital Photography website provides customers with a method to order
prints online, as well as to book appointments. The available products and services are
stated on this website, and Classic Digital is not bound to provide anything not listed. For
specifications of prints and appointments, Classic Digital allows users to interact with
company representatives via e-mail, where the terms of any print jobs can be discussed.
Any orders made online that involve specific details, must have written proof, or are
otherwise invalid. While discussing any editing and/or specific instructions on the print
and/or appointment, the company must explicitly state that an agreement has been
come to in order for it to be effective. Classic Digital is entitled to refuse any order on
reasonable grounds.
Concerning the website, if it is down for any reason, or is not functioning properly for any
reason, Classic Digital cannot be held accountable for any delays in business.
By submitting an image, the customer is automatically accepting any and all
responsibilities concerning the copyrights of said image. Classic Digital does not have
the responsibility, nor the capability, to thoroughly inspect and review the legitimacy of
each image or information submitted.
For any coupon received, the customer is bound to the terms and conditions written on
said coupon. If a submission is made using the coupon, but without a listing of the
reference number and date, both of which are specified on the coupon, Classic Digital is
not bound to fulfill the coupon. For any coupon not received by the customer, the
business has the right to give it, or not give it, at a later date, or not provide the customer
with any discount.
Classic Digital Photography cannot be held responsible for any kind of liability regarding
any promotional offers being offered at any time.
Classic digital will keep the original image files for pictures taken in our studio for 6
months, over which the customer can ask for reprints, at a separate cost. This only
applies if the customer can provide the reference number attached to the photo. If, for
any reason, a photo is not found in our archives, Classic Digital Photography can claim it
as an honest mistake and thus cannot be held liable.
Delivery
As an agreement for an online order or appointment booking, Classic Digital will reply
with a confirmation e-mail. If said e-mail is not sent back to the customer, there has been
no agreement of any kind.
Classic Digital Photography will not deliver on any national holiday, as well as any
communal / religious holiday, unless it has been communicated otherwise.
Delivery by the business is not subject to any specific date, unless specified by the
company in writing, but should be expected to reach the customer within a reasonable
amount of time.
Price and Payment
Regarding pricing and payments, Classic Digital reserves the right to decide and / or
change the prices of our products and services. These decided prices will be
nonnegotiable and will apply without prior notice to the user.
Payment must be made at any time specified by the business.
User cannot cancel an order after clicking on the "I AGREE" box and the payment has
been processed.
Private Information
Classic Digital Photography is a business that tries its absolute best to ensure that the
privacy of its customer information is not breached. In this situation, information is used
as a broad term to include any information willfully handed over by the customer to the
business. This can include photos, names, phone numbers, and more. In case of a
breach by any means, by clicking “I Agree”, the customer accepts that Classic Digital will
not be held liable for any damages of any kind that may result due to it.
Data loss may happen due to unforeseeable circumstances, third parties unaffiliated with
Classic Digital, or negligence. In all these instances, and in any other that results in data
loss, Classic Digital Photography will not be held responsible for any kind of liability.
Miscellaneous
1. If Classic Digital fails to follow through with or ensure any of the statements
above at any period of time, they shall not be held responsible for damages
suffered by the customer or any other parties involved.
2. If any term listed above is illegal or unenforceable before the law, the validity and
enforceability of the remainder of the agreement will remain in effect.
3. If a customer assigns their duties (such as conducting payment) to another party,
they must first notify and receive consent from both Classic Digital and the
assignee in written form, and deliver all proof and information to the business.
4. Classic Digital Photography will not be held liable for any of the agreements
made if a circumstance, or situations, beyond their reasonable control arise.
5. The laws of the jurisdiction in which the business is located govern this
agreement.
